OUR LETTINGS PROCESS AND TERMS
Following the Tenant Fees Act of June 2019 we have revised our fees and processes in line with the legislation. For tenancies signed after June 2019 this is our revised lettings process.

PROPERTY RESERVATION
If you wish to proceed with renting one of our properties after viewings these are the next steps:
1. Transfer a RESERVATION DEPOSIT, which is one weeks total rent to Harveys Properties Ltd. You will be provided with a unique Group ID number which needs to be referenced when making your bank transfer.
2. The reservation deposit can be made in one bank transfer or if you are a group, you may choose to each contribute an equal amount to the total.
3. We use an automated system provided by PayProp which will automatically recognise the transfers and allocate to the appropriate property.
4. Following successful completion of the lettings process which will require the signing of the tenancy agreement by 15th day. The Reservation Fee will be allocated / assigned to the first months rental payment on account.


Guarantors
 In some instances, you may require a suitable guarantor in order to pass your references. An additional fee is due in order to proceed with the guarantor application. The Guarantor must also provide us with two forms of ID. Should the Landlord be happy with the concluded references the
 REFERENCES: You are required to provide satisfactory references within the agreed timeframe when renting a property. Failure to supply the required information will result in the application being rejected and the preliminary payment being forfeited.


CONDITIONS REGARDING THE RESERVATION DEPOSIT
Following the Tenants Fee Bill 1st June 2019, the circumstances under which the reservation deposit would be forfeited are described below. The Reservation Deposit is non-refundable should any of the below situations occur within 15 calendar days (or other deadline for Agreement as mutually agreed in writing):

 You fail to provide the necessary Right to Rent documentation before the deadline.
 You fail to complete your references, provide a signed and witnessed Guarantor Agreement and sign the tenancy agreement before the agreed deadline.
 You provide false or misleading information to Harveys Properties or the landlord. If this occurs the landlord is reasonably entitled to take into account the difference between the information provided by you and the correct information in deciding whether to grant a tenancy to you and is reasonably entitled to take your action in providing false or misleading information into account in deciding whether to grant such a tenancy.
 You wish to withdraw from the Let.
 Acceptance is subject to contract and acceptable references.


SECURITY DEPOSIT
Before a tenancy commences, Tenants are required to pay a Security Deposit equivalent to five weeks of rent. The deposit is held against any damages or expenses arising during a tenancy according to the terms of the tenancy agreement and will not be released until after the tenants have vacated the property, contractual requirements have been met and all rent has been paid up to date.
DEPOSIT REGISTRATION
The Security Deposit is held by your Landlord and is registered with an Insurance backed scheme.The details of the registration will be communicated directly.


DEFAULT FEES AND DAMAGES PAYMENTS

Your tenancy will be subject to the tenancy fee act 1st June 2019. This act does not affect the Landlord/ Agent’s entitlement to recover damages for breach of the tenancy agreement or costs incurred by action/ inaction of the tenant by way of deducting from the tenancy deposit or requesting payment during the tenancy. A landlord/Agent is entitled to cover the costs of contractual breaches of the tenancy in accordance with the Landlord and Tenancy Act 1985.

ALLOWABLE FEES
• The tenants fee act specifies the following level of fees which may become chargeable should the situation described below arises:
• Late Rent: Where rent is unpaid 14 days after it is due, interest at Bank of England Base rate plus 3% will be charged on a daily basis starting from the rent due date. You can also be charged any costs / penalties the landlord has to pay his lender if a mortgage payment is missed as a consequence.
• Lost Keys: If you lose your keys you will need to pay for the replacement of the lock and key and the contractor call out costs.
• Amendment to AST / Replacement Tenant/ Change of Details: no more than £50 per request.
• Damage to the property:  As Invoiced.
• Failure to keep appointments or prevent access for required visits such as Gas Safety Inspections, periodic Inspections which had been previously agreed, unless cancelled no later than 12 hours beforehand you agree to pay any charges as per contractor invoice.
• You will be responsible for any reasonable call-out charges if you wrongfully ask for contractor to come to the property, and this is due to incorrect information, inaction on your part or against our or your Landlord’s advice. You agree to pay any charges as per contractor invoice.


INSURANCE
The Landlord is responsible for having Building Insurance and Insurance for his own belongs and contents, but not the tenant’s belongings. We highly recommend tenants take out the appropriate insurance, which includes third party cover to covert their liabilities and possessions.
